These binding terms govern access to the Elezar Pty Ltd platform and services. By using, accessing and/or subscribing to the Platform, this signifies that you have read, understood and agree to be bound by the Terms. The company reserves the right to modify terms with reasonable notice, and changes take effect immediately upon publication.
1. About the Services
The platform delivers real-time threat intelligence analysis with features to identify threat attributes, tactics, and techniques. Multiple subscription tiers are available with varying features. The subscription tiers offered, as well as the features and functionality available in each tier, may change from time to time.
2. Acceptable Use of the Services
Users must use the platform lawfully. Prohibited activities include:
- Infrastructure attacks: tampering, reverse-engineering, hacking, modifying performance, overwhelming systems, or probing vulnerabilities
- Illegal purposes or law violations
- Harassment, stalking, or threats
- Fraud through phishing, spoofing, impersonation, or false sponsorship claims
- Unauthorized access or searching outside public interfaces
- Content policy violations
- Intellectual property infringement
Elezar Pty Ltd reserves the right to suspend, cancel, or otherwise deny access to users and accounts violating these rules.
3. Security and Data Privacy
Privacy information and data handling practices are governed by Elezar's separate Privacy Policy, which addresses security breaches and data protection protocols.
4. Data Use
Elezar collects, stores, and processes user data to provide services and facilitate operations. The Privacy Policy explains data collection, storage, processing, encryption, and removal procedures, in compliance with the Australian Privacy Act 1988, the European Union General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable privacy laws.
5. Subscription to Use the Service
Users must purchase a subscription and pay applicable fees to access services. After purchase, users complete registration to create an account, providing accurate personal information including name, email, and payment details. Once you have completed the registration process, you will be a registered user of the Platform and agree to be bound by the Terms.
Access is granted immediately upon registration completion through the subscription period. Users cannot accept terms if under legal age or ineligible to form contracts with Elezar. Subscription fees may change with at least 30 days' notice. Users may cancel before new fees take effect if they disagree.
6. Payment
Subscription fees are paid through available website methods. Payments may use third-party applications not controlled by Elezar. Elezar Pty Ltd will not be liable for any losses or damage arising from the operations of third-party payment applications and services. Users bear responsibility for costs if payments are returned or denied.
7. Termination of Contract
Users may terminate by non-renewal at subscription period end or closing accounts where available. Elezar may terminate if users fail to renew, breach terms, legal requirements exist, or service provision becomes commercially unviable.
Elezar Pty Ltd reserves the right to discontinue or cancel your Subscription or Account at any time and may suspend or deny, in its sole discretion, your access for breaches, legal violations, or conduct damaging the company's reputation.
8. Limitation of Liability
Elezar's total liability does not exceed the cost of service resupply. Elezar Pty Ltd, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages, including lost profits, business reputation loss, and intangible losses.
9. Refund Policy
Refunds are provided under Australian Consumer Law and applicable consumer protection laws. Elezar offers full refunds if:
- Requested within 7 days of initial purchase
- Requested within 7 days of annual renewal
- Elezar cannot continue service provision
Refunds will be processed within 14 business days and returned to the original payment method. Account access terminates immediately upon refund processing.
10. Copyright and Intellectual Property
The platform and services are copyright-protected under Australian law and international treaties. Elezar grants users a worldwide, non-exclusive, royalty-free, revocable licence to use the product pursuant to these terms, cache product material, and print pages for personal, non-commercial use.
Elezar Pty Ltd retains all rights, title and interest in and to the Product and all related Services. Users cannot broadcast, republish, upload, transmit, distribute, publicly display, or adapt services without written permission.
11. General Disclaimer
Use of the Product and the Services is at your own risk. Everything on the Product and the Services is provided to you as is and as available without warranty or condition of any kind. Elezar will not be liable for any special, indirect or consequential loss or damage unless reasonably foreseeable.
12. Indemnity
Users agree to indemnify Elezar, affiliates, employees, agents, and licensors from all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage arising from user content, platform access, or term breaches.
13. Dispute Resolution
Before court proceedings, parties must comply with dispute resolution procedures:
- A party claiming a dispute must provide written notice detailing the dispute nature, desired outcome, and required settlement actions
- Parties must negotiate in good faith within 28 days
- If unresolved, parties agree on a mediator and share fees equally
- Mediation conducted via video conference or mutually agreed location
- All communications are confidential and without prejudice
- Either party may request mediation termination after 2 months
14. Venue and Jurisdiction
- Australian customers: Exclusive venue is Victoria courts
- EU customers: Proceedings may occur in home country courts or company principal business jurisdiction
- US customers: Disputes resolve in state/federal courts of customer's state
- Other jurisdictions: Disputes resolve in company principal business jurisdiction courts
15. Governing Law
- Australian customers: Victoria law without conflict of law principles
- EU customers: Home country law per mandatory consumer protection requirements
- US customers: Home state law without conflict of law principles
- Other customers: Company principal jurisdiction law
16. Beta Features and Experimental Services
Elezar occasionally offers beta, pilot, limited release, early access, or evaluation features. Beta Features are provided for testing and evaluation purposes only and may not be suitable for production use.
Beta features may contain bugs, function incompletely, be modified or discontinued without notice, lack standard security commitments, and cause unexpected results or data loss. Beta Features are provided on an as is and as available basis without any warranties.
Users grant Elezar a non-exclusive, worldwide, royalty-free licence to use any feedback, suggestions, or ideas provided regarding Beta Features.
17. Service Modifications and Discontinuation
Elezar Pty Ltd reserves the right to modify, update, suspend, or discontinue the Platform or any part of the Services at any time, with or without notice, for any reason, including improving functionality, compliance, security, or addressing market changes.
For discontinued material features or services with active paid subscriptions, Elezar provides at least 30 days' notice and offers pro-rata refunds or alternative comparable services if available.
Elezar Pty Ltd shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services, except as expressly provided in these Terms or as required by applicable law.
